Perusahaan yang hanya menawarkan CTX dapat memilih mendaftar sebagai DCM biasa atau sebagai CAM dengan aturan yang disesuaikan untuk transaksi aset kripto. <\/span><span style=\"font-weight: 400;\">Platform yang menawarkan <\/span><i><span style=\"font-weight: 400;\">futures<\/span><\/i><span style=\"font-weight: 400;\">, <\/span><i><span style=\"font-weight: 400;\">options<\/span><\/i><span style=\"font-weight: 400;\">, atau <\/span><i><span style=\"font-weight: 400;\">swaps <\/span><\/i><span style=\"font-weight: 400;\">tetap berada dalam kerangka DCM yang berlaku saat ini.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kerangka CAM juga mempertimbangkan sejumlah ketentuan khusus kripto, mulai dari pengawasan pasar, integritas keuangan dan perlindungan dana pelanggan hingga potensi kewajiban <\/span><i><span style=\"font-weight: 400;\">proof of reserves<\/span><\/i><span style=\"font-weight: 400;\"> bagi bursa yang menyimpan aset pelanggan dalam akun omnibus.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">CFTC juga mempertimbangkan penggunaan Futures Commission Merchant (FCM) sebagai perantara dalam CTX. FCM akan menangani rekening dan dana pelanggan dengan kewajiban terkait modal, pengungkapan, pemisahan aset pelanggan, serta sejumlah ketentuan anti-pencucian uang.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Bursa_Spot_Kripto_Tidak_Otomatis_Masuk_CFTC\"><\/span><b>Bursa Spot Kripto Tidak Otomatis Masuk CFTC\u00a0<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Meski menawarkan kerangka federal baru, proposal tersebut tidak berarti seluruh bursa kripto AS akan diwajibkan mendaftar ke CFTC.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bursa yang hanya menawarkan perdagangan spot biasa umumnya tetap berada di bawah aturan <\/span><i><span style=\"font-weight: 400;\">money transmission<\/span><\/i><span style=\"font-weight: 400;\"> negara bagian.<\/span><span style=\"font-weight: 400;\"> CFTC memiliki kewenangan anti-penipuan dan anti-manipulasi terhadap pasar tersebut, tetapi tidak memiliki kewenangan untuk mewajibkan seluruh bursa spot kripto mendaftar hanya melalui proposal ini.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sebaliknya, kewajiban pendaftaran berlaku bagi platform yang menawarkan perdagangan dengan <\/span><i><span style=\"font-weight: 400;\">margin<\/span><\/i><span style=\"font-weight: 400;\">, <\/span><i><span style=\"font-weight: 400;\">leverage<\/span><\/i><span style=\"font-weight: 400;\">, atau pembiayaan kepada pelanggan ritel.<\/span> <span style=\"font-weight: 400;\">Platform yang juga menyediakan <\/span><i><span style=\"font-weight: 400;\">perpetual contracts<\/span><\/i><span style=\"font-weight: 400;\"> dan derivatif lainnya berada pada kategori pengawasan CFTC yang lebih luas.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Artinya, kerangka yang sedang disiapkan CFTC lebih tepat dilihat sebagai opsi dan jalur regulasi federal untuk aktivitas kripto tertentu, bukan pengambilalihan seluruh pengawasan pasar spot dari regulator negara bagian.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">CFTC membuka proses konsultasi publik terhadap proposal tersebut. Komentar tertulis akan diterima selama 60 hari setelah pemberitahuan diterbitkan di Federal Register, sebelum regulator bergerak lebih lanjut dalam proses penyusunan aturan.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"CFTC_dan_SEC_Bergerak_setelah_CLARITY_Gagal\"><\/span><b>CFTC dan SEC Bergerak setelah CLARITY Gagal\u00a0<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Langkah CFTC menjadi bagian dari perubahan regulasi yang lebih luas setelah <\/span><a href=\"https:\/\/www.nanovest.io\/blog\/berita\/clarity-act-gagal-voting-bitcoin-tertekan-25489\/\"><span style=\"font-weight: 400;\">CLARITY Act gagal maju di Kongres<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"> RUU tersebut sebelumnya dirancang untuk memperjelas pembagian pengawasan pasar aset digital dan memberikan landasan hukum yang lebih permanen bagi struktur regulasi kripto AS.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tanpa legislasi tersebut, CFTC memilih menggunakan kewenangan yang sudah tersedia dalam Commodity Exchange Act untuk menyusun aturan CTX dan CAM. Ketua CFTC Michael Selig mengakui bahwa hanya Kongres yang dapat mewajibkan seluruh bursa aset kripto mendaftar ke lembaganya.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">SEC juga telah mengambil jalur serupa. <\/span><span style=\"font-weight: 400;\">Pada Agustus, regulator sekuritas tersebut mengusulkan Regulation Crypto Assets, yang menyediakan kerangka penawaran khusus untuk <\/span><i><span style=\"font-weight: 400;\">investment contract<\/span><\/i><span style=\"font-weight: 400;\"> tertentu yang melibatkan aset kripto.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Proposal SEC mencakup dua pengecualian dari kewajiban registrasi Securities Act, masing-masing untuk penawaran hingga US$5 juta dalam empat tahun dan hingga US$75 juta dalam setiap periode 12 bulan, disertai persyaratan pengungkapan dan perlindungan investor tertentu.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Namun, aturan yang dibuat regulator memiliki karakter berbeda dari undang-undang yang disahkan Kongres. Ketua SEC Paul Atkins sebelumnya menyatakan legislasi tetap penting untuk menghasilkan aturan yang lebih tahan terhadap perubahan kebijakan regulator di pemerintahan berikutnya.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bagi pasar kripto, perkembangan berikutnya akan bergantung pada hasil konsultasi CFTC, perkembangan proposal SEC, serta apakah Kongres kembali mencoba mengesahkan kerangka struktur pasar yang lebih permanen.
